Abstract
This increased dependence on artificial intelligence (AI) independent of human involvement in the process of corporate work is transforming the nature of the entire process of decision-making and questions the long-established system of corporate liability and accountability. Harm and loss to artificial intelligence by operation regimes of limited human influence, adaptive learning, and obscure decision-making logic can be difficult to comprehend by traditional, human-centric approaches through the prism of the law, e.g. negligence, vicarious liability or product liability. This chapter critically examines the legal and ethical concerns, and the governance concerns, which the autonomous AI implies in regard to the key functions of a corporation like human resources, finance, healthcare, customer service, and manufacture. Using the comparative regulatory trends and international standards, the chapter explains the new gaps in accountability concerning transparency accountability, causation, and sharing responsibility. The chapter suggests the principles of a lifecycle based and a distributed accountability that would include legal enforceability, ethics, and corporate governance mechanisms to overcome the existing challenges. The suggested framework is a realistic guideline to corporate figures, regulating groups, and AI programmers that can help bring the issue of responsible AI control and re-writing corporate accountability into the present-day discussion of the responsible AI governance and the re-writing of the core principles of corporate liability in the age of Autonomic Operation System.
