Abstract
This article examines the challenges of informed consent in the context of collecting neurophysiological data through artificial intelligence technologies. It argues that conventional consent models fail to address the specific risks to mental privacy and cognitive freedom, thereby requiring a reconsideration of both their substance and the modalities of their provision. The study outlines potential avenues for further research and suggests practical measures, including the establishment of a prohibition on the secondary use of data, the implementation of dynamic consent with the right of withdrawal, and the adoption of digital platforms and interactive formats designed to strengthen both the awareness and the voluntariness of consent.
